1. The service
PrismDraft helps teams plan, draft, illustrate, review and publish articles. It drafts outlines, articles and images with third-party artificial-intelligence models, keeps a review and approval step before publication, and can publish approved articles to a connected CMS or send them to a webhook.
The features available at any time are those described on the website and in the application. The Publisher may change, add or withdraw features to improve the service; a change that removes a paid feature you rely on is announced in advance.
2. Professional customers only
PrismDraft is offered to professionals: companies, associations, freelancers and other people acting for the purposes of their trade, business or profession. By accepting these terms you confirm that you use the service in that capacity and, where you act for an organisation, that you may bind it.
Because the service is sold between professionals, the consumer withdrawal right and the consumer mediation provisions of the French Consumer Code do not apply.
3. Account and security
An account requires a valid email address, which must be verified, and either a password of at least 12 characters or a Google sign-in. The information you give must be accurate and kept up to date.
You are responsible for keeping your credentials, API keys and the credentials of connected publishing services confidential, and for everything done with them. Tell the Publisher without delay at the address below if you suspect unauthorised access.
4. Workspaces and members
Content, credits and subscriptions belong to a workspace. The person who creates a workspace is its Owner and may invite members and give them roles. The Owner is responsible for the members invited and for their use of the workspace, and the workspace's credits, plan and content are shared with them according to their roles.
5. Acceptable use
You agree not to use PrismDraft to:
- create, store or publish content that is unlawful, defamatory, hateful, violent, deceptive, or that infringes someone else's rights, including copyright, trademarks and personal data;
- produce spam or large volumes of misleading or manipulative content, or impersonate a person or organisation;
- supply files or URLs you have no right to use, or point the service at systems you are not allowed to access;
- probe, overload, disrupt or bypass the security, limits or billing of the service, or access it other than through its interfaces and documented API;
- resell or provide the service to third parties as such, or copy it to build a competing product.
You are responsible for the content you supply and for what you publish. The Publisher does not review content before it is generated or published, but may remove content or suspend access, as set out in section 13, when it is told of or finds a clear breach.
6. AI-generated content
Outlines, articles, images and suggestions are produced by artificial-intelligence models from your settings and sources. They can contain errors, out-of-date or invented facts, or passages close to existing works. Generated content is a draft: you must review it, check its accuracy and its rights, and decide whether to publish it. The service's approval step exists for that purpose.
To generate content, your instructions and the content needed for the task are sent to the AI providers listed in the Privacy policy. The Publisher does not use your content to train models.
7. Intellectual property
You keep all rights in the content you supply and in the content generated for you, to the extent such rights exist; the Publisher claims none. You grant the Publisher, for the duration of your use, a non-exclusive and free licence to host, process, reproduce and transmit that content only as needed to provide the service, including sending it to AI providers and to the publishing destinations you connect.
The service itself, its software, design and brand belong to the Publisher. These terms give you a personal, non-exclusive and non-transferable right to use it for your professional needs while your account is open.
Images stored in PrismDraft, whether generated or uploaded, are served from an address that anyone who holds the exact link can open, so that they display once published. These addresses are not listed or discoverable, but do not store images there that must stay confidential.
8. Credits
Generation is paid for in credits. The price in credits of each operation is shown on the pricing page and before each run; at the date of these terms, an article costs two credits per started 1,000 words in Premium writing and one in Standard writing, an image costs one credit (three in HD) whether generated or regenerated, a fact-check costs three credits and research one, while outlines and AI edits cost no credits. Credits are reserved when a run starts and settled when it ends: what the run did not deliver returns to the balance, and a run that produced nothing is not charged.
- Plan credits are added with each paid month of a plan and are spent first. Any that are left expire at renewal and when the plan ends.
- Credits from a top-up pack, and the free credits granted when you sign up, do not expire while the workspace exists.
- The free sign-up credits are granted once per email address, including after an account has been deleted.
- Credits have no cash value. They cannot be exchanged for money, refunded or transferred to another workspace, and they are lost when the workspace is deleted.
9. Plans and subscriptions
A plan is a monthly subscription that adds credits each month and sets the workspace's limits (members, projects, AI edits). It starts when the first payment succeeds and renews automatically each month at the price then in force, until it is cancelled.
You can change plan or cancel at any time from the billing page, which opens the billing portal of the payment provider. A cancellation takes effect at the end of the paid period: the plan stays active until then, then the workspace returns to the free plan. An upgrade during a period is charged at once, pro rata, by the payment provider; a downgrade takes effect at the next renewal. Months already paid are not refunded.
If a renewal payment fails, the payment provider retries it; while it remains unpaid, the workspace may fall back to the free plan's limits.
10. Prices and payment
Prices are those shown on the pricing page at the time of purchase, in euros. VAT is not applicable under article 293 B of the French General Tax Code (CGI), so the price shown is the price paid.
Payment is made by card or another method offered through Stripe, the payment provider. The Publisher never sees or stores your card details. Credits from a pack are added once the payment is confirmed by Stripe; plan credits are added with each paid invoice. Invoices and receipts are issued through Stripe and available from the billing page.
A change in the price of a plan is announced by email at least 30 days before it applies, and applies from the next renewal after that date; you may cancel before then. Pack prices may change at any time and apply to later purchases.
Any amount due and unpaid bears late-payment interest at three times the French statutory interest rate, plus the fixed indemnity of €40 for recovery costs provided by article L. 441-10 of the French Commercial Code.
11. Refunds
As credits are used as soon as they are added and the service is sold to professionals, payments are final and are not refunded, except where the law requires it or where the Publisher agrees to it. If a pack payment is refunded or reversed, the credits it added are removed from the balance in proportion to the refunded amount, as far as they have not been used.
12. Availability, support and your data
The Publisher makes reasonable efforts to keep the service available and secure, but does not guarantee that it will run without interruption or error. Maintenance, updates, incidents and the availability of third-party providers (hosting, AI models, payment, email) can interrupt it.
The Publisher backs up the service's data every day and keeps each backup for 2 days, to recover the service after an incident. Backups are not a way to restore an individual item on request, so you remain responsible for keeping your own copies of content that matters to you. Each article can be exported as Markdown, HTML or JSON, or as a ZIP with its images, at any time.
Support is provided by email at contact@prism-draft.com, on a best-effort basis.
13. Suspension and termination
You may stop using PrismDraft and delete your account at any time from your account settings. Deletion is permanent: it removes every workspace of which you are the only Owner, with its content, files and credits, and cancels its subscription immediately, without refund. Workspaces you share with other Owners remain, without you.
The Publisher may suspend or close an account or a workspace in the event of a serious or repeated breach of these terms, after a notice by email that has gone unremedied for 8 days, or without notice where the breach is unlawful or endangers the service or other users. Credits and months already paid are then not refunded.
The Publisher may also end the service as a whole, with at least 60 days' notice by email; plan periods paid beyond that date are then refunded pro rata.
14. Liability
The Publisher is bound by an obligation of means. It is liable only for direct damage caused by its own fault, proved by you. It is not liable for indirect damage such as loss of revenue, customers, data or reputation, nor for content you publish, for decisions made on the basis of generated content, or for failures of services it does not control, including your publishing destinations.
To the extent the law allows, the Publisher's total liability for any claim is limited to the amounts you paid for the service during the 12 months before the event giving rise to it.
You indemnify the Publisher against any claim by a third party arising from content you supplied or published, or from your breach of these terms.
15. Personal data
The Publisher processes personal data as described in the Privacy policy. For the personal data contained in the content you put into PrismDraft, you act as controller and the Publisher processes it on your behalf, only to provide the service, under the conditions of the Privacy policy.
16. Changes to these terms
The Publisher may change these terms. Substantial changes are announced by email or in the application at least 30 days before they apply. If you do not accept them, you may close your account before that date; continuing to use the service afterwards means accepting them.
17. Governing law and disputes
These terms are governed by French law. In the event of a dispute, the parties will first seek an amicable solution. Failing that within 30 days, the dispute will be brought before the competent courts of Chartres, France, including in the event of multiple defendants or third-party proceedings.
